The following are the Terms and Conditions applicable in respect of Melita plc’s (“Melita”) Internet Upgrade Offer (“the Offer”). Access to the benefits of this Offer is subject to the following Terms and Conditions. By partaking in this Offer, you are agreeing to all of these Terms and Conditions, without modification. 1. The Offer is available to all existing Melita internet subscribers (“the Customers”) registered to the Medium or Large internet connection only, Customers subscribed to a Melita Bundle are not eligible for this Offer.
2. This Offer starts from the 7th May 2010 (“Start Date”) and will continue until the 31st July 2010 (“End Date”), both days inclusive.
3. These Terms and Conditions must be read in conjunction with Melita’s standard terms and conditions (the “Agreement”) and with the Melita internet terms & conditions of service and/or with any other applicable terms and conditions. Access to the terms and conditions referred to in this clause 3 and to any other applicable terms and conditions is available by visiting https://www.melita.com/. In case of conflict between these terms and conditions and Melita standard terms and conditions or any other applicable terms and conditions, then these terms and conditions shall apply.
4. Any Customer eligible for this Offer will, until the 30th June 2011 (“Termination Date”), benefit from an upgrade to the internet connection subscribed to, subject to an increase in price as indicated hereunder. For the purpose of this Offer, the internet connections that are included in this Offer are the Melita Medium and Large Internet connections and the prices for the Offer are as follows:
(i) Internet Medium (Standard Full Rate) @ €14.35/month upgraded to Internet Large (Upgraded Discounted Rate) @ €20.49 until Termination Date.
(ii) Internet Medium +2 (Standard Full Rate) @ €16.35/month upgraded to Internet Large (Upgraded Discounted Rate) @ €20.49 until Termination Date.
(iii) Internet Large (Standard Full Rate) @ €30.76/month upgraded to Internet XL (Upgraded Discounted Rate) @ €40.49 until Termination Date.
For the avoidance of any doubt the Standard Full Rate for the Melita internet XL connection is €65.50.
5. All the charges for provision of the internet service shall be at the Customers sole expense, including any connection and/or installation fee. All charges shall be due as of the date that the service is installed.
6. Upon termination of the Offer, the Customer shall be charged the Standard Full Rate of the upgraded Melita internet connection unless the Customer opts to revert back to the original internet connection by giving due notification in writing. Customers eligible to this Offer cannot revert back to the original internet connection prior to the Termination Date.
7. In the eventuality that the Customer during the Offer period fails to meet any of the payments due, Melita reserves the right to suspend/terminate the Offer with respect to that particular Customer and charge the standard full rate for the Melita Internet package subscribed to.
8. Melita reserves the right to stop, suspend, amend or otherwise alter this Offer and these terms and conditions at any time without giving prior notice.
